If an individual is in the Custody of the Bureau of Immigration and Customs Enforcement (ICE) it may be possible to post an immigration bond. There are two types of Immigration Bonds that are currently available: the delivery bond and the voluntary departure bond. In order for the delivery bond to be posted the individual will be issued a notice of Custody Conditions and a Warrant of Arrest. Not every detainee will be able to post a delivery bond. The bond is the “insurance” that the individual will show up for their future court date. After the person shows up for his or her court date, the amount paid for the delivery bond is returned. If the defendant does not show up for their court date, the delivery bond is forfeited and the full amount of the bond belongs to the court. The other type of immigration bond is the voluntary departure bond. With this type of bond the person agrees to leave the country at their own expense within a certain amount of time. If they do not leave the country the bond is forfeited and more legal troubles ensue.
